At least 2020 ends with a budget deal and pandemic relief

This year has been filled with unpredictability and turmoil. Our way of life has been negatively impacted. We have been forced to distance ourselves from those we love, our co-workers, and our traditions. 

COVID-19 has been incredibly challenging for people experiencing homelessness. Economists estimate that homelessness could increase by up to 32% as a result of COVID-19 related issues.  

With your help, we have been pushing Congress to include both short and long-term housing and other economic relief for everyday people. We are encouraged by the relief package and omnibus budget signed into law by the President this week.

This new $900 Billion COVID-19 relief plan includes:

  • $25 billion for rental assistance (click here see how much your state will receive)
  • Extends the  federal eviction moratorium for 1 month and use of CARES funding set to expire on 12/30/20 to 12/31/21.
  • $13 billion for enhanced Supplemental Nutrition Assistance Program benefits.
  • Provides direct payments of  at least $600 to adults and $600 per child. Families with incomes under $75,000/year. (Two parent household up to $150,000)
  • $284 billion for Paycheck Protection Program /small business loans. 
  • $20 billion for small business grants and $15 billion for live event venues.
  • $300 billion for federal unemployment supplement and temporarily keep in place pandemic-era programs that expanded unemployment insurance eligibility, this will allow 12 million people to remain on  unemployment insurance and enhance the 11 weeks of benefits by $300/week.
  • $20  billion for purchase of  vaccines, $8 billion for disbursement of vaccines and also provides relief to hospitals.
  • $82 billion for schools and colleges.
  • $10 Billion Child Care Assistance

The omnibus Fiscal Year 2021 budget passed includes:

  • A permanent, minimum 4% Low-Income Housing Tax Credit rate, as well as disaster housing credits for qualified states, which could result in the addition of more than 130,000 units of affordable housing;
  • A five-year extension of the New Markets Tax Credit (NMTC) at $5 billion for a total of $25 billion in new NMTC authority;
  • $4.839 billion for the Public Housing Operating Fund;
  • $3 billion for Homeless Assistance Grants; and
  • $2.765 billion for the Public Housing Capital Fund.
  • The 2020 CoC NOFA is postponed and current programs will be re-funded for one year (which we have pushed for since early in the pandemic!)

We still need more, both short and long term housing and other supports for everyday folks who have been impacted most by the pandemic and resulting economic downturn. We look forward to the new Congress and Administration focusing more on these issues as we move into a new decade!

The National Coalition for the Homeless released its annual report on bias-motivated violence against people experiencing homelessness on December 21, 20 Years of Hate, outlines the 39 lethal attacks and the 44 non-lethal attacks that occurred in 2018 and 2019 throughout the United States. December 21st also marks 30 years of remembering the deaths of people experiencing homelessness through Homeless Persons’ Memorial Day.  

The report discusses the structural violence that has created endemic poverty, and proposes legislative solutions to lawmakers and advocates working to protect people experiencing homelessness from violence. Combining statistics and narratives, 20 Years of Hate provides an in-depth look at the types of crimes homeless individuals experienced in 2018 and 2019, from police brutality to stabbings. The report breaks down lethal and non-lethal crimes by state, and each crime is documented by city, date, and description. 

The report will be released on December 21, 2020, which commemorates the 30th Annual National Homeless Persons’ Memorial Day, a remembrance of those who have passed away during the year while unhoused. Events will be held nationwide to remember thousands who may not have had memorial services. A growing number of cities have been releasing annual reports on the number of community members who have died while homeless. 20 years of Hate only documents a fraction of these deaths. As the National Health Care for the Homeless Council points out, life expectancy for someone who is homeless can be 20-30 years younger than the general population. The National Coalition for the Homeless has estimated that annually, there are 13,000 individuals who die on our streets. The National Healthcare for the Homeless Council have partnered with groups around the country to create a Mortality Toolkit now available to help give a more accurate count of those who have perished on the streets of America.

This year’s 20 Years of Hate report marks the 20th year the National Coalition for the Homeless has analyzed bias-motivated violence that leads to many deaths among the homeless community. The Federal Bureau of Investigation (FBI) has documented increases in reported Hate Crimes against federally protected classes since the 2016 elections. The numbers of attacks reported against people experiencing homelessness have decreased during this time. It is likely that as political views have bifurcated, bias against federally-protected classes has become more accepted or promoted in the mainstream culture. Still, the data collected by the National Coalition for the Homeless demonstrates that bias-motivated violence against homeless persons continues to be highly prevalent in our communities. 

California saw the most crimes against people experiencing homelessness in 2018 and 2019. Often considered ground zero for homelessness, Los Angeles, in particular, saw almost 10% of overall incidents recorded, from acid attacks and video-taped stabbings to police officers murdering a homeless man after a noise complaint. There is a clear correlation between the growing visible presence of homelessness, as occurs in Los Angeles, and the number and severity of attacks from housed persons.

Federal and local legislation could help to prevent bias-motivated violence against people experiencing homelessness, adding housing status as a protected class under hate crimes statutes or vulnerable victims sentencing guidelines. However, as evident from the crimes outlined in 20 Years of Hate, a cultural shift is needed to change how US society treats and values our homeless population, in order to prevent hate crimes and to build healthy and compassionate communities.

In January 2010, NCH released a report on Winter Services that detailed extended shelter hours and other services that work to decrease the risk of hypothermia deaths among people who are homeless. Hypothermia refers to the life-threatening conditions that can occur when a person’s core temperature drops below 95 degrees Fahrenheit.

NCH’s Winter Services report in 2010 found that 700 people experiencing or at-risk of homelessness are killed from hypothermia annually in the United States. A similar report from the Center for Disease Control (CDC) that looked at data from 1999 to 2003 found that on average 688 deaths each year were due to hyperthermia. While the CDC report does not mention the housing status of those who passed away due to heat-related illnesses, we can relate the risks to people who are homeless to the CDC’s recommendations for preventing hyperthermia.

Last year in Los Angeles, despite the typical sunshine and mild temperatures, five homeless people died of causes that included, or were complicated by, hypothermia, surpassing San Francisco and New York City, which each reported two deaths. Over the last three years, 13 people have died at least partly because of the cold in LA, the coroner’s office said. And advocates worry that increased cold, rainy winter will mean more fatalities.

This year, the pandemic will exacerbate these issues. The country is facing an explosion of individuals entering the homeless system as eviction moratoria and unemployment benefits expire. In the past faith-based organizations have come to the rescue in many cities providing Hypothermia Shelters on their properties. This year many of those faith-based facilities are shuttered due the rising number of COVID-19 cases nationwide. Even with the expected approval of a COVID vaccine before the end of 2020, it will take at least six to nine months to implement.

It is vitally important that communities utilize Cares Act Funds and ESG to house those living on the streets. As Congress waits America Freezes. Please call your Congressperson and ask them to pass a stimulus bill now.

Earlier this year, the Centers for Disease Control (CDC) came out with their recommendation on how to address homeless encampments during the COVID pandemic. The CDC statement read that

… if individual housing options are not available, allow people who are living in encampments to remain where they are. Encourage people living in encampments to increase space between people and provide hygiene resources in accordance with the Interim Guidance for People Experiencing Unsheltered Homelessness

For advocates and people experiencing homelessness, this was an exciting statement that spoke to what we all know to be the truth, that homelessness is a public health emergency and that sweeps exacerbate health risks for those living outdoors. The CDC recommended providing access to clean water, hand washing stations, bathrooms, and regular trash pick up for people living outdoors. We thought maybe this would be an opportunity for communities across this country to re-think encampment sweeps, and the criminalization of homelessness. For a little while, in many communities, that is what happened. 

Meanwhile, due to funding cuts and social distancing restrictions, massive congregate shelters had to downsize their occupancy. Some people got transferred to hotels/motels or other services while others went outdoors. Further, as the pandemic economic downturn started to cause real hardship, more folks were forced to seek emergency housing assistance. With shelters at capacity, more people were forced outdoors and after just a few short months, municipalities across this country resumed encampment sweeps, going against CDC guidelines. 

Encampment sweeps aren’t the only thing that continued, the criminalization of ‘quality of life crimes’ came back in full force. In Hawaii, the Civil Beat, reported that the city of Honolulu received $38 million in CARES Act, and the Honolulu Police Department received at least $16 million of that for overtime pay. This overtime pay is suppose to be used to enforce they current mayor’s pandemic rules, however those who were most cited happened to be people experiencing homelessness.

One man has been cited nearly 100 times since March for 199 supposedly pandemic related violations. He has also received 37 tickets for quality of life crimes. Once someone receives a citation they are required to appear in court. A missed court appearance can turn into a bench warrant and lead into an arrest. In citing people experiencing homelessness for little else than not having anywhere to quarantine or social distance, the city of Honolulu not only is being incredibly cruel, but it is creating a dangerous situation for health of the entire community. 

The National Coalition for the Homeless urges localities put into practice the CDC guidelines on unsheltered homeless, and protect this vulnerable population from unnecessary risk of COVID infection, especially as the weather turns cold. We also demand that cities and states end of the practice of criminalizing poverty and homelessness!

Thank you to all people who have experienced homelessness who took the time to make their vote count in the 2020 elections! Thank you also to the advocates who worked to ensure that voting was accessible to those experiencing housing instability. As our community relies on government-funded programs and services to provide critical needs, it is critical that we all make our voices heard, not just in elections, but in keeping our elected officials accountable to those most in need after being elected!

There’s a huge divide in America. Most believe that divide is either racial, economic, political or a combination of all three. They would be right. What about affordable housing? The heart of the matter lies in who is dominating the conversation regarding what’s affordable. The divide in the affordable housing conversation is racial, economical, and political. Let’s tackle income inequality, for starters, the federal minimum wage. Some would say our nation should explore provide universal basic income. Already underway and is a plus. See the pattern here? The individual, organization, or government entity directing the narrative determines what’s affordable and what’s not affordable. What income level is suitable and what is not. It was refreshing for a change to see the people determine what’s suitable regarding the recent events in Philadelphia, PA. 

For years, the Philadelphia Housing Authority has ignored its most vulnerable citizens. Eligible housing units that the poor can qualify to live in sits empty. This is by design. Developers and housing investors stalk their prey with lobbying efforts to develop something called mixed income communities. America, that’s just a fancy way to disguise “gentrification”. On average, a larger number of poor people that leave their neighborhoods behind never return. Philadelphia is no different. Empty housing just occupies city space while over 40,000 people sit on a waiting list for public housing. This is a normal practice in America. Make the poor sit and wait. Developers, house flippers, and city governments leave out the people that need it most, well, not this time. 

Lawyers, activists, and the unhoused seized on the opportunity to grab the attention of America with advocates that know something about grabbing attention; Black Lives Matter. It’s a marriage that ties housing and justice together. The people taking matters into their own hands may repair fractured relationships between housing authorities and the citizens they are supposed to serve. The journey started out with a simple demand; provide housing or we will take to next steps to provide housing for ourselves.

Well, of course, city hall did not listen, setting the stage for what would happen next. Close to 200 of Philadelphia’s most vulnerable people took over a park at 22nd and Ben Franklin Parkway in a neighborhood known for the lifestyle of the rich and famous. In this same time period, fifteen unoccupied housing authority homes became property of the people. The conditions may not have been ideal; however, it forced the housing authority to look at a much greater problem, humanity. Encampments were strategically set up in various parts of the city to force action. 

After months of political posture, an agreement was reached. The city agreed to turn over 50 public housing units including the fifteen occupied during a citizen take over.  These homes will be in a land trust meaning housing will be affordable for the poor and operated by the people. One of our sources who participated in the negotiations shared the following, something you may not hear with the national media:

Jobs are available through the trade union. Houses are being fixed up in North and West Philadelphia, and the formerly unhoused are welcome and will contribute to keeping the character of the neighborhood. While this is a landmark deal that will have implications nationwide, it comes with a set of challenges as well. The city council still continues the practice of political gamesmanship and owns a graveyard set up for housing policy. While it is much appreciated for the Philadelphia Housing Authority to grant 50 houses, it is still not enough for the estimated 6,000 plus unhoused people that remain in Philadelphia. Finally, the practice of encampment sweeps will continue in the midst of a global pandemic.

The fight for housing, which is a “human right”, has remained an issue since the Fair Housing Act of 1968. Discrimination has reached an all time high in punishing the poor just because they are poor. Will other housing authorities nationwide join Oakland, and Philadelphia using land trust models? Will the people have to take matters into their own hands or can we depend on housing authorities to do the right thing? Have we, or will we finally reach a moment of reconciliation in America? The jury is still out and has not yet reached a verdict. 

We are now only a matter of days away from the November 3rd general election. While registration deadlines have passed in many states, there are still places where you can register in person, and possibly even cast a provisional ballot on election day. There is lots coming out in the news about polling locations, voter suppression tactics, and last minute candidate education efforts. We wanted to be sure that people with unstable housing, and their advocates, have the latest information to ensure that all residents of the country can exercise their right to vote!

Evictions are more complicated than just the actual meaning. At its root cause, we may be able to list job loss, medical issues, and loss of spouse/domestic violence as examples that are at the surface. It’s bigger than someone failing to fulfill their obligation in exchange for not being on the street.

Estimated numbers of people at risk of eviction are staggering; 30 to 40 million in the next several months are at risk for becoming housing insecure according to the Aspen Institute. 

There are 3 things currently standing in the way of mass displacement due to eviction:

  • CDC moratorium
  • Local moratorium
  • Legal Aid and rental assistance 

On September 2, 2020, The Center for Disease Control Director Dr. Robert Redfield signed a declaration determining that the evictions of tenants could be detrimental to public health. This action was instrumental since the CARES Act moratorium expired in late July.

Some city and state governments issued eviction prevention moratoriums at the beginning of the public health emergency which have since expired.

Three main reasons why tenants are still being evicted from their homes:

  • Landlord intimidation of tenants
  • Tenants not aware of their rights as renters
  • Lack of legal representation in court 

Landlords have taken measures into their own hands during this public health crisis. While they depend on payments for survival, boarding up doors, shutting of utilities, and filing for eviction with the courts does not make a tenant speed up their ability to pay rent. The fine print on a lease may become a challenge to understand and it’s a tool used by management companies to evict.

What can be done to protect the American People?

A fifth coronavirus package to protect the American people, extending the CDC moratorium beyond December is pivotal in blocking the wave of evictions. An executive order by local, and state governments can potentially protect certain groups of Americans from evictions such as the elderly, and domestic violence survivors.

There are benefits for families to stay in their homes. Kids are able to focus in school and decrease the chance of suffering from lack of rest and food insecurity. Prevention of long term mental instability is also a plus.

Should we have hope in that a piece meal approach that has slowed down what’s inevitable? Or will people remain hopeless in the lack of assistance to help Americans sustain their quality of life?

Make no mistake, the United States will face a housing crisis not seen since the great depression regarding housing insecurity. Most moratoriums put in place at the beginning of the pandemic have expired causing massive amounts of eviction filings by landlords.

What will happen if the CDC moratorium on evictions is not extended past December 2020? The jury is still out on that answer, however, the American people must have a say, and challenge our elected officials to do what they were elected to do, legislate.

Whitehead, who has served as the NCH Board President for the past year, will give up that role to devote his full-time effort as Executive Director.  Previously, Whitehead has directed several programs serving people experiencing homeless including outreach and case management, health care, emergency shelter and permanent supportive housing.  He has also served as a national advocate and an Organizational Management Consultant focused on homelessness and racial equity.  He brings a unique combination of direct service to those experiencing homelessness as well as years of advocacy for systemic change to end homelessness through increased federal investment in housing and services as well as an end to policies that criminalize homelessness.  Whitehead is also a veteran who served three years in the U.S. Navy.

The National Coalition for the Homeless (NCH), founded in 1981, is the oldest national organization focused on ending homelessness in America.  It is a national network of people currently experiencing or who have experienced homelessness, activists and advocates, community-based and faith-based service providers, and others committed to their mission of: To end and prevent homelessness while ensuring the immediate needs of those experiencing homelessness are met and their civil rights protected. Over the last 38 years through advocacy efforts addressing the root causes of homelessness including lack of affordable housing, and partnering to write landmark legislation including the McKinney-Vento Homeless Assistance Act of 1987.

The hiring of Whitehead to lead NCH was made possible by an anonymous two-year capacity building grant.

Sue Watlov Phillips will become Board President of NCH.  Watlov Phillips has worked together with people experiencing homelessness by addressing both the immediate needs and structural causes of homelessness for over 52 years and currently serves as Executive Director of MICAH – Metropolitan Interfaith Council on Affordable Housing in Minnesota.

Dr. Rajni Shankar-Brown serves as Board Secretary of NCH.  Shankar-Brown is an internationally renowned scholar-educator and social justice activist in education, is a leading expert on child and family homelessness, diversity and transformative leadership, community engagement and human rights. Dr. Shankar-Brown is a professor and the Jessie Ball duPont Endowed Chair of Social Justice Education at Stetson University, as well as the Founder and Executive Director of the Poverty and Homelessness Conference.

Barbara Anderson serves as Board Treasurer of NCH.  Anderson served for 24 years as Executive Director of Haven House, an emergency shelter and service center for families and individuals experiencing homelessness in rural Indiana.  She is currently devoting her time full time to advocacy and organizing on behalf of those experiencing homelessness in rural communities.

In 2019, NCH entered into a strategic alliance with the Colorado Coalition for the Homeless (CCH)  to leverage the strengths of each organization towards a renewed focus on elevating the crisis of homelessness being experienced in communities across America and increasing organizing and advocacy for immediate action at the Federal level to end homelessness and reduce its trauma on the millions of individuals and families experiencing homelessness and those at imminent risk of losing their homes. The agreement allowed NCH to build its capacity to focus on its strength of bringing together those experiencing homelessness to share their experiences with our nation’s leaders in a call for immediate action to end homelessness.  The Colorado Coalition for the Homeless will continue to provide its administrative, financial and policy capacity to support NCH’s renewed efforts as Whitehead assumes his new position.
